Florida Bills Threaten Sporting Dog Breeders

Florida State Representative Bryan Avila and State Senator Manny Diaz have introduced legislation in both chambers to classify a person who sells more than four dogs per year as a professional breeder, subjecting those individuals to regulations intended for commercial businesses. House Bill 1237 and Senate Bill 1698 are awaiting a committee referral.

Currently in Florida, laws specify that breeder regulations apply to all wholesale and retail pet dealers that sell more than two litters or 20 pets each year. From there, any licensing required for dog breeders are regulated on a local level.

HB 1237 and SB 1698 would treat someone who sells less than one litter of puppies the same as a large commercial operation. Professional breeders will be subjected to regulations that will drive up the cost of puppies. Because small breeders don’t generate much income, this legislation will eliminate the types of breeders that hunters depend on for quality hunting dogs.

“There is no justifiable reason to treat someone selling just a handful of dogs a year with the same regulatory structure as commercial operations,” said Jacob Hupp associate director of state services at the Sportsmen’s Alliance. “Sporting dog kennels haven’t done anything to deserve being over-regulated and driven out of business by costly and unnecessary regulation more suitable for large for-profit operations.”
